Terms of Service

1. Acceptance of Terms: By booking a food tour with Puerto Viejo Food Tours, you agree to be bound by these Terms of Service. Please read these Terms of Service carefully before booking your tour.

2. Booking and Payment: To book a food tour, you must make a reservation through our website or by calling us at 1.805.824.2700. Full payment is required at the time of booking. We accept .

3. Cancellation Policy: Any cancellations made prior to 48 hours before the tour are gladly given a refund. After that 48 hour mark, there are no refunds. If you cancel between 48 hours and 24 hours before the event time, we will give you a credit for service and you may use it to book with us at a later date. There are no refunds, credits, or exchanges offered for any reason if you cancel with less than 24 hours notice. 

4. Modifications to Tours: We reserve the right to modify or cancel food tours due to unforeseen circumstances, such as weather conditions or vendor availability. If we modify or cancel a food tour, we will notify you as soon as possible.

5. Food Allergies and Dietary Restrictions: In general, we can not accommodate for food allergies and guarantee it, as we do not prepare the food and the kitchens are not ours. If there is a specific question about an allergy and ingredients in the food beforehand, please contact us and we will do our best to get that information to you so you can make a decision. Something isolated like a papaya allergy can be accounted for as we can check against a list of foods served. However, something more global like a nut allergy, celiac disease or a seafood allergy encompass too many types of food and can not be accommodated for. If you have a question, please ask and we will do what we can, but this is never guaranteed. 

YES WE CAN ACCOMODATE: alcohol free, vegetarians, and pescatarians

NO WE CANNOT ACCOMODATE: vegans, gluten allergies or celiac disease, nut allergy, dairy free, general food allergies. Because we do not run the kitchens and we rely on restaurant partners to prepare food items, we cannot guarantee dishes will be prepared within your dietary requirements.

We are not responsible for any illness resulting from consumption of food or alcohol products on this tour. We need at least 48 hours to make arrangements for any food that deviates from our normal menu. Please keep that in mind when booking the tour. 

6. Consumption of Alcohol Our food tours may include stops at venues that serve alcohol. Please drink responsibly and do not consume alcohol to the point of intoxication.

7. Behavior Please be respectful of our guides, other participants, and the vendors we visit. We reserve the right to terminate your participation in a food tour if your behavior is deemed disruptive or offensive.

8. Release of Liability You agree to release and hold harmless Puerto Viejo Food Tours, its affiliates, partners, employees, and agents from and against any claims, liabilities, damages, injuries, or losses arising out of or in connection with your participation in a food tour, including, but not limited to, claims for foodborne illness, personal injury, or property damage/ loss.

9. Indemnification You agree to indemnify and hold harmless Puerto Viejo Food Tours, its affiliates, partners, employees, and agents from and against any and all claims, liabilities, damages, injuries, or losses arising out of or in connection with your breach of these Terms of Service.

10. Entire Agreement These Terms of Service constitute the entire agreement between you and Puerto Viejo Food Tours and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of Costa Rica.

12. Severability If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck from these Terms of Service and the remaining provisions shall remain in full force and effect.

13. Waiver No waiver of any provision of these Terms of Service shall be effective unless in writing and signed by both parties.

14. Additional Terms

In addition to the above, the following terms and conditions apply to your participation in a food tour:

  • You must be at least 18 years of age to agree to participate in a food tour.

  • You must be able to walk for at least two hours.

  • You must wear comfortable shoes that are suitable for walking.

  • You may bring your own water bottle.

  • You may bring a small backpack or purse.

  • You are responsible for your own belongings.

  • We are not responsible for any lost, stolen, or damaged belongings.

  • We reserve the right to refuse service to anyone who is under the influence of alcohol or drugs.

  • We reserve the right to remove anyone from a food tour for disruptive or offensive behavior.
